Effect of Non-suit before the Claims Commission

In the recent opinion of the Tennessee Supreme Court in Haley v. University of Tennessee-Knoxville the Supreme Court accepted a question of law certified by the United States District Court of the Eastern District of Tennessee to determine whether a voluntary non-suit before the Tennessee Claims Commission activitates the waiver provision of T.C.A. 9-8-307(b), barring a federal or state cause of action arising from the same act or omission as the claim before the Claims Commision.
